Terms of Service

These Terms of Service ("Terms") govern your access to and use of SupaImagine (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Service Description

SupaImagine lets you generate content using artificial intelligence. Output is produced by third-party AI models; SupaImagine does not manually create output on your behalf.

SupaImagine is an independent service and is not affiliated with, endorsed by, or sponsored by any third-party AI model provider whose technology, products, or trademarks may be referenced on this site. All product and company names are trademarks of their respective owners and are used for identification purposes only.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the consent of a parent or legal guardian.

3. Your Account

You are responsible for keeping your credentials secure and for all activity under your account. Notify us immediately at support@supaimagine.ai if you suspect unauthorized access.

4. Credits and Payment

The Service uses a prepaid credit system. Purchasing credits or subscribing constitutes agreement to our pricing as displayed at time of purchase. Prices may change prospectively; changes do not affect credits already purchased.

5. Generated Content

Your rights in generated content. Your rights in the content you generate depend on your plan:

  • Paid plans: Subject to your compliance with these Terms, and to the extent permitted by law and the upstream model providers, you own the content you generate and may use it for any lawful purpose, including commercial use. SupaImagine claims no ownership over your prompts or paid-plan output.
  • Free plan: You receive a personal, non-commercial license to use the content you generate. Commercial use of free-plan output is not permitted; upgrade to a paid plan to obtain commercial rights.

Non-exclusivity. AI models may produce similar or identical output for different users given similar prompts. SupaImagine makes no guarantee that your generated content will be unique.

Our license. You grant us a non-exclusive, worldwide, royalty-free license to host, store, and display your generated output solely as needed to operate the Service (including showing it in your account history and, if you opt in, public galleries).

6. Commercial Use

Commercial use of generated content requires a paid plan. Free-plan output may be used for personal, non-commercial purposes only; on a paid plan you may use your generated content for commercial purposes, subject to these Terms. In all cases you are solely responsible for clearing any third-party rights (trademarks, likeness, copyrighted material referenced in prompts, etc.) before commercial use.

7. Prohibited Content

You may not use the Service to generate content that:

  • is sexually explicit, pornographic, NSFW, or sexually suggestive — regardless of whether the subjects appear to be adults; content sexualizing minors is strictly prohibited
  • is produced with face-swap, deepfake, or face-manipulation techniques applied to real people
  • depicts a real, identifiable person without consent (including public figures in misleading contexts)
  • incites violence, self-harm, or illegal acts
  • infringes intellectual property rights
  • includes private or personal data of others without a lawful basis
  • violates applicable law in your jurisdiction or ours

A fuller list of prohibited content and conduct is set out in our Acceptable Use Policy, which forms part of these Terms. We may refuse, remove, or refund any generation at our discretion when we believe it violates this section.

8. Refunds

Credits are refundable under the conditions described in our Refund Policy. Generated output is generally non-refundable because underlying compute has already been consumed.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms or if required by law. On termination, unused credits are refundable under the Refund Policy; generated content may be retained as required by law or deleted at our discretion.

10. Disclaimers

The Service is provided "as is" without warranties of any kind. AI output may be inaccurate, offensive, or unsuitable for your use case. We do not warrant that the Service will be uninterrupted or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, SupaImagine is not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

12. Changes to These Terms

We may update these Terms from time to time. Material changes take effect 30 days after notice (by email or in-product banner). Continued use of the Service after the effective date means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts of Delaware, unless prohibited by your local law.
